Limit Your Pets
Question: I'm wondering if anyone knows if your landlord is allowed to limit your pets. Whether it is landlord, private non profict housing or what not, are they allowed to limit the number of pets for your residence? I know that they cannot stop you from having animals, but am unsure if there has been anything in the courts about the limit on animals. I know someone has a link on a previous thread for the info on allowing pets, the court decision on that, but I just acn't find it right now. Any info would be appreciated, thanks. Answer: All I could find in the "regie des logements" so far is about subletting: Certain conditions of the sublease may be different from those of the main lease but they must not come into contradiction with the main lease so as to give the sub-tenant more rights than the tenant already has. For instance, if it is forbidden in the tenant's lease to keep an animal, the sub- tenant cannot keep one. On the other hand, if an animal is allowed according to the main lease, the sublease can forbid it. It would be the same for a parking space and so forth. Answer: I live in East York in Toronto in a private residence. We are allowed 2 dogs (used to be 3 - grandfathered of course so no pet ever passes on). Not sure about # of cats - used to be no limit, but my understanding is that has changed. So I would say that it is a municipal by-law. I don't have a lease agreement (renting from MIL ) but I do know that the city laws say that anything over a certain number of dogs has to have a kennel license, I just can't remember how many. Answer: In New York private housing can actually forbid pets in a building... not that many listen to it. We are trying to pass legislation forbidding owners to forbid pets. Answer: I live in Co-operative Housing, in Ontario. We follow the Tenant Protection Act for some things, but not all. Others we make our own by laws. HOWEVER, those by laws, of course, cannot go against human rights. I know that under TPA you cannot be forbid from having animals. However, not sure if that applies to limiting animals as well. Right now, in my co-op, we have a very badly worded by law which states you are able to have two contained animals, and two uncontained animals. The word 'contained' ... can be taking quite strictly (ie, tank, bowl, cage) or, taken liberlly (sp) to mean room, or entire house. What is contained? My cat, is contained within my house, as it does not go outside. She could even be contained to a room. Other members have brought this up before, and no one has a true answer as to what is contained, as ppl see it differently. Also, if you think about the way the by law is worded, two contained animals, that would mean fish in a tank, meaning you are only allowed two fish in a tank, if we want to interpret this strictly. In my city, I know the pet by law, which is 2 dogs (to avoid puppy milling) and there is no limit on cats. I'm jsut venting and trying to figure things out. Our entire pet by law needs to be re-written, as they have banned certain dogs from the co-op, which should not be allowed. Also, there is a size limitation we have to go by. They have never eveicted a person because of pets so... Back to the topic. . . .I think it depends on the ownership of the property. . .if its a private rental (like a room in someones house) they can specify - but I'm not sure about normal rentals. . . Don't know if this will help but I'm in a similar situation; my condo board is threatening to remove my dog from my property (I OWN my condo!). Answer: not entirely on topic, but i do know that cities often limit the # of pets you can have... like in Mtrl (at least the Ville-Marie burrough), you can have 2 eaach cats and dogs.
