Dog rights
Question: I apologize if I've posted this question in the wrong forum but here goes... Does anyone know the laws/ by-laws within Toronto around condo management offices fining dogs for going to the washroom on the lawn outside of the building? The condo I live in have experienced many instances where dog owners have not been picking up after their dogs. Understandably, residents living on the ground floor are not happy. Recently, the management office has posted a notice to all residents saying "any resident allowing their dog to go the washroom on the lawn will be heavily fine." Do they have a right to fine people that let their dogs go on the common lawn BUT pick up after the dog? Any advice/ feedback would be appreciated. Answer: i know here in montreal each condo association makes thier own "laws", my friend who is in a codo has a booklet of all the rules and regulations and one of them is if there is a dog that makes noise the condo association can vote on wether the dog can stay there, so I would look in to you particular associations rules Answer: More than likely, yes they can do this. If this is a condo you own, and you pay condo fees--then there is likely a board of residents who sit regularly to make up these sorts of rules. As representatives of the community, they vote and enact certain rules--like the one you've just outlined. Condo corps are a big deal these days--and for the most part, the member who sit on the board get very dedicated to ensuring that all common spaces, and the general makeup of the community is just perfect. I've heard of some condo boards even regulating what you can put on your balcony!! Answer: As long as the laws they ave instituted do not go against your human rights, yes, they can create such a law. Also, interestingly enough, you're by law will supercede a city by law, if it is stricter than the city by law. Example: In my co-operative housing, we have a noise by law, not to be making loud noises (music, parties, cutting the grass) after 10 pm. The citys by law is 11 pm for such things. Since ours is 10 pm, ours does supercede the cities, and they can be fined. Answer: Copyright © 2007 - 2008 www.tendlife.com
